Eminent Domain Victories for Property
Owners and Governmental Bodies

 

The Firm recently had several victories on different ends of the eminent domain spectrum. First, Lawrence H. Shapiro, as trial counsel for a property owner in Middlesex County, obtained a settlement of one million dollars more than the offer made by the New Jersey Turnpike Authority in a partial taking case. Then on the Municipal side, Mr. Shapiro was successful in obtaining a jury verdict in the first Asbury Park eminent domain trial of $400,000. This was more than $700,000 below the amount the property owner was seeking and $286,000 less than the Court appointed Commissioners' determination of value of the property. Also on the Municipal side, James G. Aaron, City Counsel for Long Branch, was successful in defeating challenges to the City's redevelopment plan of the Broadway corridor in which the Court ruled that the challenges to the plan raised by the property owners were without merit.
