Favorable Eminent Domain Decisions

for the City of Asbury Park

 

Lawrence H. Shapiro, a partner in the Firm, as attorney for the City of Asbury Park, successfully tried the condemnation case City of Asbury Park v. McLoughlin, et al, wherein the Monmouth County jury found that a 3-story Victorian home on the 200 block of Second Avenue, located 2 blocks from the beach, was worth only $375,000 as of July 24, 2006, where the prior property owner challenged the value as $750,000, and the City had appraised the property at $335,000. This decision follows on the heels of a jury verdict for another of Mr. Shapiro’s condemnation cases on behalf of the City, City of Asbury Park v. U.S. Appliance & Recyclers, Inc., wherein a jury valued the subject property at just $400,000 as of April 22, 2005, where the owner asserted a value of over $1.2 million. Representing the property owner, Mr. Shapiro also recently obtained a $3.1 million dollar settlement for the Firm’s client in the condemnation case New Jersey Turnpike Authority v. New Carteret Shopping Center Associates, LLC, where the Authority's offer had been $1,975,000.
